Validity Period of Form I-693 changed November 1, 2018

USCIS revised policy guidance for the validity period of Form I-693, Report of Medical Examination and Vaccination Record. Two timelines were significantly changed.

First, Form I-693 should be signed by a civil surgeon no more than 60 days before filing the underlying application for an immigration benefit. If the Form I-693's signature is older than 60 days on the day the application is filed, the form is invalid. According to the policy guidance in Volume 8,Part B of the USCIS Policy Manual, the applicant will need to update  his/her I-693.

The second change is the length of time the Form I-693 remains valid. The time has been extended from 1 year to 2 years. The purpose of the changes are to keep the form current longer and hopefully through the application process. The challenge will to file the application within 60 days of the completion of the form.

USCIS - Re-Registration Period Now Open for Salvadorans with Temporary Protected Status

Direct from USCIS  Bulletin:

" WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) announced today that current beneficiaries of Temporary Protected Status (TPS) under El Salvador’s designation who want to maintain their status through the effective  termination date of Sept. 9, 2019, must re-register between Jan. 18, 2018, and March 19, 2018.

Re-registration procedures, including how to renew employment authorization documents, have been published in the Federal Register and on uscis.gov/tps.

All applicants must submit Form I-821, Application for Temporary Protected Status. Applicants may also request an Employment Authorization Document (EAD) by submitting a completed Form I-765, Application for Employment Authorization, at the time of filing Form I-821, or separately at a later date. Both forms are free for download on USCIS’ website at uscis.gov/tps.

USCIS will issue new EADs with a Sept. 9, 2019, expiration date to eligible Salvadoran TPS beneficiaries who timely re-register and apply for EADs. Given the timeframes involved with processing TPS re-registration applications, however, USCIS recognizes that not all re-registrants will receive new EADs before their current EADs expire on March 9, 2018. Accordingly, USCIS has automatically extended the validity of EADs issued and currently valid under the TPS designation of El Salvador for 180 days, through Sept. 5, 2018.

On Jan. 8, Secretary of Homeland Security Kirstjen M. Nielsen determined that the statutory conditions supporting El Salvador’s TPS designation on the basis of an environmental disaster are no longer met. Secretary Nielsen made her decision to terminate TPS for El Salvador after reviewing country conditions and consulting with appropriate U.S. government agencies. To allow time for an orderly transition, she also delayed the effective date of the termination for 18 months from the current expiration date of March 9, 2018. As a result of the delayed effective date, El Salvador’s TPS designation will end on Sept. 9, 2019.

Salvadorans with TPS may wish to consult with qualified immigration attorneys or practitioners about their eligibility for another immigration status or benefit, or whether there is any other action they may want to take regarding their individual immigration circumstances."

USCIS Introduces Redesigned Form for Green Card Applicants

Direct from the USCIS Bulletin:

"Today [06/26/2017] we published the following news release, available here on our website.

WASHINGTON - U.S. Citizenship and Immigration Services today published a revised Application to Register Permanent Residence or Adjust Status (Form I-485). The new Form I-485 and instructions have been substantially updated to reduce complexity after collecting comments from the public and stakeholders.

The revised version gives applicants better information to accurately complete Form I-485, including clear navigation to the parts of the form and instructions that are relevant to the applicants’ specific situations. These updates should increase the efficiency of the adjudication process by reducing errors and requests for evidence.

Applicants living in the United States file Form I-485 to adjust their immigration status and become lawful permanent residents, which allows one to live and work permanently in the United States.  Adjusting status is a critical step for those seeking U.S. citizenship.

USCIS also revised the Form I-485 Supplement A and Form I-485 Supplement J (as well as each supplement’s instructions), to provide applicants with more detailed information about how to properly complete, file, and submit evidence if those supplements are applicable to their situation.

Beginning today, there will be a 60-day grace period during which USCIS will accept both the  01/17/17 and 06/26/17 editions of Form I-485 and Supplement A and J. Beginning Aug. 25, USCIS will only accept the revised Form and Supplement A and J of Form I-485 and will no longer accept earlier versions of either form.

What’s New? USCIS improved Form I-485 to include:
  • Better flow and organization of questions to make it user-friendly for both the applicants and USCIS. In addition, readability has significantly improved due to new spacing, columns, flow, white space, and formatting.
  • The questions about biographic information (Form G-325A) so applicants will no longer need to file a separate form;
  • A list of 27 immigrant categories, which allows applicants to identify the specific immigrant category under which they are applying; and
  • A comprehensive, updated list of admissibility-related questions. The added questions to ensure USCIS officers have the necessary information to better assess the applicant’s admissibility and eligibility.
What Remains the Same

While both Form I-485 and its instructions may look different from earlier versions, the process for filing Form I-485 and Form I-485 Supplement A and Form I-485 Supplement J remains the same. Applicants must still submit their paper applications to the location listed in the form instructions.

Further information

Visit the Form I-485, Application to Register Permanent Residence or Adjust Status  page and the Form I-485 Supplement A page for further information about the new forms and instructions.

Applicants can visit the USCIS Green Card Eligibility Categories page for information on eligibility requirements for each immigrant category.

All USCIS forms are free on our website at www.uscis.gov/forms.

USCIS ... New fees and forms ...

USCIS Fees changed in December 2016. USCIS Forms change all the time. I always advise my clients to check for new forms before they do anything on their own. I also explain to them the reason I look up the forms in their presence is to make sure we have the most current version before we start.

Direct from the USCIS Bulletin:
"Previous Editions of Forms Accepted Until Feb. 21, 2017, but Must Include New Fees
12/29/2016
When new fees for most USCIS forms went into effect on December 23, 2016, we published updated versions of the forms at uscis.gov/forms. We strongly encourage customers to submit these new versions, which are updated with the new fees and have an edition date of 12/23/16.

We will accept prior versions of forms, with the exception of Form N-400, until February 21, 2017.  However, all filings postmarked 12/23/16 or later must include the new fees or we will reject them.

We will accept only the 12/23/16 edition of Form N-400, Application for Naturalization.
The updated forms are currently available only at uscis.gov/forms, where all of our forms can be downloaded for free. We will issue another alert when paper copies become available through our forms request line (800-870-3676) and forms by mail service.

Immigration - simple tip - have you moved? don't forget to change your address with USCIS

I also practice immigration law, mostly for families. One of the common mistakes I am finding with my clients is they move and do not realize they need to inform US Citizenship and Immigration Services (USCIS). Most non-U.S. citizens must report a change of address within 10 days of moving within the United States or its territories. This can cause problems as a person moves from an immigrant visa to a permanent legal resident to a US Citizen.

It is a pretty simple process. On the USCIS website, it has a page - Change of Address Information. It provides guidance and gives you access to the AR-11 form most people need to use to notify USCIS of the address change. This can help avoid unnecessary problems.

USCIS- DHS Announces 18-Month Redesignation and Extension of Temporary Protected Status for Syria

Direct from USCIS:

"WASHINGTON—Secretary of Homeland Security Jeh Johnson has redesignated Syria for Temporary Protected Status (TPS) and extended the existing TPS designation for the country from Oct. 1, 2016, through March 31, 2018. This allows eligible nationals of Syria (or persons without nationality who last habitually resided in Syria) to register or re-register for TPS in accordance with the Federal Register notice published today [1 August 2016].

Who is Eligible
Current TPS Status
When to File
Current TPS beneficiaries from Syria
Have TPS
To extend your TPS, you must re-register during the 60-day re-registration period that runs from Aug. 1, 2016, through Sept. 30, 2016.
Syrian nationals and persons without nationality who last habitually resided in Syria, who have:
  • Continuously resided in the United States since Aug. 1, 2016, and
  • Been continuously physically present in the United States since Oct. 1, 2016.
Do not have TPS
To obtain TPS, you may apply for TPS during the 180-day initial registration period that runs from Aug. 1, 2016, through Jan. 30, 2017.

Individuals re-registering for TPS:

Current beneficiaries under Syria’s TPS designation seeking to extend their TPS status must re-register during a 60-day period that runs from Aug. 1, 2016, through Sept. 30, 2016. U.S. Citizenship and Immigration Services (USCIS) encourages beneficiaries to re-register as soon as possible.

The 18-month extension also allows TPS re-registrants to apply for a new Employment Authorization Document (EAD). Eligible Syria TPS beneficiaries who re-register during the 60-day period and request a new EAD will receive one with an expiration date of March 31, 2018. USCIS recognizes that some re-registrants may not receive their new EADs until after their current work permits expire. Therefore, USCIS is automatically extending current TPS Syria EADs with a Sept. 30, 2016, expiration date for an additional six months. These existing EADs are now valid through March 31, 2017.
To re-register, current TPS beneficiaries must submit:

Individuals applying for TPS for the first time:

For Syrian nationals (and persons having no nationality who last habitually resided in Syria) who do not currently have TPS, the TPS redesignation may allow them to apply for TPS if they have continuously resided in the United States since Aug. 1, 2016, and have been continuously physically present in the United States since Oct. 1, 2016. Applicants must meet all other TPS eligibility and filing requirements.
To apply for the first time, individuals must submit:
Individuals who still have a pending initial TPS application under Syria’s designation do not need to submit a new Form I-821. However, if they currently have a TPS-related EAD and want a new EAD, they should submit:
Applicants may request that USCIS waive any fees based on inability to pay by filing Form I-912, Request for Fee Waiver, or by submitting a written request. Fee-waiver requests must be accompanied by supporting documentation. USCIS will reject the application of any applicant who fails to submit the required filing fees or a properly documented fee-waiver request.

All USCIS forms are available for free. Download forms or order them by mail through the USCIS website at uscis.gov/forms or by calling the USCIS Forms Request Line toll-free at 1-800-870-3676.

Applicants can check their case status at My Case Status Online or by calling the USCIS National Customer Service Center at 1-800-375-5283 (TDD for the deaf and hard of hearing: 1-800-767-1833).
